OUR TERMS OF SERVICE

Introduction:
These Terms of Service (the "Terms") govern your use of our aircraft charter services (the "Services"). By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

Eligibility:
To use the Services, you must be at least 18 years of age and have the legal capacity to enter into a contract.

Service Description:
The Services provided by Fly AI include the chartering of aircraft for transportation of passengers and cargo. Fly AI shall use reasonable efforts to provide the Services in a safe and timely manner.

Payment:
Payment for the Services shall be made in accordance with the terms agreed upon at the time of booking. Fly AI reserves the right to cancel any flight if payment is not received in a timely manner.

Cancellation and Refunds:
Cancellations must be made at least 72 hours before the scheduled flight. If a cancellation is made within 72 hours of the scheduled flight, the full charter fee will be charged. Refunds will only be issued if the flight is cancelled by Fly AI due to weather or mechanical issues.

Liability:
Fly AI shall not be liable for any damages resulting from the use of the Services, including, but not limited to, damages resulting from delay or cancellation of a flight, or from the loss or damage of baggage or cargo.

Indemnification:
You agree to indemnify and hold Fly AI and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Services.

Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law.

Changes to Terms:
Fly AI reserves the right to make changes to these Terms at any time. Your continued use of the Services following any changes to these Terms will be deemed acceptance of those changes.
